1. Purpose & Scope
This policy governs (a) how Subscribers may seek a refund or service credit and (b) how any dispute arising from the Service is resolved. It forms part of the Dutify.AI Terms of Service.
2. Key Definitions
Subscriber: Individual or entity purchasing a paid plan.
Billing Cycle: The monthly or annual period prepaid in advance.
Service Credit: Non-cash credit applied to future invoices.
SLA: 99.5 % monthly uptime, excluding announced maintenance (48 h notice).
3. Refund Rules
- Free Trials – No charge; cancel anytime before trial ends to avoid billing.
- Cooling-Off Rights – If mandatory in your jurisdiction (e.g., EU, UK, certain U.S. states), you may cancel within the statutory period for a full refund.
- Monthly Plans – Cancel anytime; plan stays active until period-end. No cash refunds for partial months. If continuous downtime exceeds the SLA or we materially breach the Terms and fail to cure within 10 days, you may request a pro-rata Service Credit for each full, unused day.
- Annual Plans –
- Within 30 days of first purchase → 100 % refund on request.
- After 30 days → pro-rata Service Credit for each full, unused month (net of any promo discount).
- One-Time Add-Ons / Professional Services – Non-refundable once delivered, unless not provided as described.
- How to Request – Email info@dutify.ai (include account ID, invoice #, reason, evidence). We respond within 10 U.S. business days. Approved refunds go to the original payment method; credits appear on the next invoice.
4. Dispute Resolution
- Support Ticket (Day 0-30) – Open via info@dutify.ai within 30 days of the event.
- Internal Escalation (Day 30-60) – If unresolved, send a concise written notice to info@dutify.ai. Senior management replies within 15 U.S. business days.
- Mediation (Optional) – Either party may request non-binding online mediation through JAMS; costs shared 50/50.
- Binding Arbitration – Any claim not settled above is finally resolved by JAMS arbitration under its Streamlined Rules:
- Seat / Governing Law: State of Delaware, USA.
- Hearing Location: Wilmington, DE or video conference at either party’s option.
- Language: English.
- Small-Claims Carve-Out: Either party may file an eligible claim in small-claims court in the county of the Subscriber’s billing address or New Castle County, DE.
- Class-Action & Jury-Trial Waiver – Disputes are individual; no class, collective, or representative actions. Jury trials are waived.
5. Governing Law
This policy, the Terms, and any related non-contractual claims are governed by Delaware law, excluding its conflict-of-laws rules.
6. Limitation of Liability
Refunds or Service Credits described herein are your sole and exclusive remedy for any failure by Dutify.AI to provide the Service or comply with this policy.
7. Policy Changes
We may update this policy by posting a revised version at https://beta.dutify.ai/refund-and-return-policy and emailing 30 days’ notice to the account owner. Continued use after the effective date is acceptance.
